These Terms of Service ("Terms") govern your access to and use of the services provided by Harkin For Computer Systems & Communication Equipment Software Design L.L.C trading as Harkin ("Harkin", "we", "our", or "us") via our web application, messaging services (including WhatsApp integration), and any associated software or tools (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of Service

You must be at least 18 years old and legally authorized to represent a business in order to use Harkin's services.

You agree to:

  • Provide accurate business and user information.
  • Use the Service only for lawful business purposes.
  • Not misuse or interfere with our systems or APIs.

2. WhatsApp Messaging

Our Service enables clients to send messages via Meta's WhatsApp Business Cloud API. By using this feature, you agree to comply with:

You are solely responsible for obtaining valid consent from customers before sending any WhatsApp messages, including promotional or marketing messages.

3. Account and Access

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity under your account.

We reserve the right to suspend or terminate your account at our discretion if we suspect abuse, illegal activity, or violations of these Terms.

4. Payment and Fees

Harkin may charge subscription fees or usage-based charges for access to certain features. All payments are due according to the plan selected and are non-refundable unless otherwise stated.

5. Data Privacy

Use of the Service is subject to our Privacy Policy, which explains how we collect, store, and use personal data.

You agree to only collect and transmit user data that is lawfully obtained and necessary for business communication. You must not share or upload personal data without proper authorization.

6. Intellectual Property

All content, software, and branding associated with the Service are the exclusive property of Harkin For Computer Systems & Communication Equipment Software Design L.L.C or its licensors. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Third-Party Services

We may integrate with third-party services (e.g., WhatsApp, Meta, Firebase). We are not responsible for their functionality, terms, or data handling. Your use of those services is subject to their respective terms.

8. Disclaimer and Limitation of Liability

We provide the Service on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the extent permitted by law, Harkin will not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

9. Termination

We may terminate or suspend access to the Service at any time without notice for any reason, including violation of these Terms.

Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.

11. Changes

We may update these Terms from time to time. We'll notify you of significant changes, but it is your responsibility to review them periodically. Continued use of the Service constitutes acceptance of the revised Terms.
